Qualifications For An L1 Visa
In order to qualify for an L1 Visa, both the business and the employee will need to meet certain qualifications. Some of the requirements for the employer and the employee are:
- Employer Requirements: The employer must have a relationship with a foreign company (qualifying organization) and must also be willing to do business as an employer in the United States and one other country. (Directly or through a qualifying organization)
- Employee Requirements: The employee must have been working for the employer abroad for at least one year. Another requirement is that the employee that is entering the United States will be providing service in an executive or managerial position for that employer.
How To Apply For An L1 Visa
In order to receive an L1 Business Visa, you will need to fill out an application for it. The application will be reviewed and approved by the INS Regional Service Center and could take roughly a month to process. If the application is approved, the notice will then be sent to the US Consulate and the employee will then receive the L1 Visa. Once the employee is in the United States, they will have the liberty to change their immigration status moving forward.
Once granted an L1 Visa, the employee will be eligible to stay in the United States for one year. If the business has already been doing business in the United States, then the employee will be eligible to stay for 3 years. L1 Visas allow for the employee to apply for 2 year extensions at a time.
